Copyright, is a bundle of rights, which grants protection to the unique expression of ideas. Ideas per se cannot be protected; it is the expression of ideas in a material medium that is the subject matter of copyright protection.

What kind of work can be registered under copyright law?

In India, copyright can be taken for original works of:

  • Musical works
  • Literary works like books and Song Lyrics,
  • Cinematography films – Audio Visuals or Video,
  • Sound Recordings- Song, Audio Recordings
  • Artistic works like paintings, trademark etc.
  • Software and other computer programs

Procedure:

Indian Copyright Act, 1957 under Chapter X and Copyright Rules, 2013 under Rule 70, mention the procedure about the registration of copyrights in India:

  1. Application: Application with requisite documents with FORM XIV. Note: A separate application has to be made for separate works.
  2. Dairy Number will be issued after application is submitted. There is a mandatory waiting time for a period of 30 days for any objections to be received generally referred as waiting period.
  3. If any objection is received, the examiner will send a letter to both the parties about the objections and will give them both a hearing.
  4. If no objections received within 30 days, the application will move further for examination followed by Registration.
  5. After the hearing, if the objections are resolved the application will move further for registration/rejection.
