Design registration

Design registration in India protects the unique visual features of an industrial product. It grants exclusive rights to the owner, preventing others from copying or using the design without permission.

  • Protects: Shape, configuration, pattern, ornamentation, or composition of lines or colors applied to an article.
  • Not protected: Features that are purely functional, mechanical, or covered by copyright or trademark laws. • Process: Filing an application, examination by the Controller General of Patents, Designs and Trademarks, potential opposition proceedings, and finally, grant of registration. 
  • Benefits: Legal protection, market exclusivity, brand enhancement, and commercialization opportunities.
  • Term: A registered design is valid for 10 years from the date of filing and can be renewed for an additional 5 years.

Procedure:

    • Formal examination: The CGPDTM examines the application for completeness and adherence to the prescribed format.
    • Search and examination: The design is examined for novelty and originality. The examiner may raise objections if the design is found to be similar to existing registered designs or lacks novelty.
  3. Addressing Objections (if any)
    • If objections are raised, the applicant has the opportunity to respond and address them. This may involve amending the application or providing further evidence.
  4. Publication of the Design
    • Once the objections are resolved, the design is published in the “Designs Journal” for public viewing. This allows third parties to oppose the registration if they believe the design infringes upon their rights.
  5. Opposition Proceedings (if any)
    • If any oppositions are filed, the CGPDTM will conduct hearings and consider the arguments of both parties.
  6. Grant of Registration
    • If the design is found to be registrable and no valid oppositions are filed, the CGPDTM will grant registration and issue a certificate of registration.
